Conditions of Carriage

All passengers, their luggage and vehicles are carried in accordance with the Company’s “Conditions of Carriage” which are displayed in full at Condor offices, on board Condor vessels, at www.condorferries.com and otherwise available on request; these shall be deemed to form part of the contract of carriage and to have been accepted and agreed by the passengers themselves and also on behalf of the persons travelling with them and also on behalf of the owner of any luggage, effects and vehicles and goods being carried. The word “passengers” includes all persons accepting, receiving or using the ticket or travelling under the ticket. In particular it should be noted:

  1. That the provisions of the Athens Convention relating to the Carriage of Passengers and Their Luggage by Sea 1974 (as supplemented where relevant by the Carriage of Passengers and Their Luggage by Sea (United Kingdom Carriers) Order 1998) are incorporated in the Condor Limited Conditions of Carriage of Passengers, Their Accompanied Luggage and Accompanied Vehicles by Sea.

This convention limits in various circumstances the liability of Condor Limited (or any other relevant carriers), for death or personal injury, loss or damage to goods (including vehicles), and makes special provision for valuables. Further, this convention presumes that luggage has been delivered undamaged, unless written notice is given to Condor Limited, or any other relevant carrier.

    1. In the case of apparent damage, before or at the time of disembarkation or re-delivery; or
    2. In the case of damage which is not apparent or of loss, within 15 days from the date of disembarkation or re-delivery, or from the time such re-delivery should have taken place. In other cases, refunds may be given at the Company’s discretion up to the cost of the unused portion of the ticket.
  2. In the case of disruption, delay or cancellation of services for reasons outside the Company’s reasonable control, the Company accepts no responsibility for any costs or consequences arising therefrom, and no refund will be due for passengers and/or vehicles conveyed by another operator.
  3. The Company reserves the right to refuse passage to any persons whom they may consider likely to disrupt the well-being of the voyage or constitute a safety hazard to the vessel. In such instance, the Company will not be liable for any additional costs, or other consequences, howsoever caused.

PROHIBITED ARTICLES
Merchant Shipping (Dangerous Goods) (Amendment) Rules 1979 prohibit the carrying of certain articles, i.e. explosives, gases, radioactive or magnetic materials, flares, fireworks etc.

UNACCOMPANIED CHILDREN
We regret we are unable to carry children under the age of 13 years unless they are accompanied by an adult, parent or guardian. Unaccompanied children between the ages of 14 and 15 intending to travel alone, will be required to carry a letter of authority to travel from their parents or guardian and by prior arrangement the necessary documentation must be completed at the departure port before embarkation. Such child passengers must be escorted by the responsible parent or guardian to and from the ports.

DISABLED PERSONS
Facilities for disabled passengers are limited, with restricted access. Whilst every assistance will be given this may require that persons in a wheelchair are carried between lower and upper levels. Please advise when booking if assistance is required with embarkation.

MEDICAL CONDITIONS AND PREGNANCY
Travel by sea in adverse weather conditions can be stressful and unpleasant. Passengers with known or suspected health problems, complicated pregnancies and passengers undergoing medical treatment are advised to seek medical advice before travelling. Passengers who are more than 28 weeks pregnant should not travel without a doctor’s certificate. The Company will not accept passengers for carriage more than 34 weeks pregnant.

ANIMALS
Animals, with the exception of certificated sensing dogs, must not be taken into any passenger accommodation. Animals being carried under the terms of the Pet Travel Scheme (PETS) can only be carried in a vehicle. Animals will be refused carriage if the documentation appears to be incorrect, but acceptance for carriage by the Company gives no warranty that the documentation is correct. The Company shall not be liable for any loss, damage or expense arising from its failure or refusal to carry any such animals or the consequences of incorrect documentation.

Accompanied access to the vehicle deck whilst the ship is at sea is subject to approval by the ship’s master. Unaccompanied access to the vehicle deck whilst the ship is at sea is strictly forbidden. The Company shall not be liable for any costs including re-booking, cancellation, vet fees, kennelling or any similar documentation for the animal(s) presented. The PETS scheme operates from St. Malo to Poole, Guernsey and Jersey. Special arrangements can be made on the St. Malo to Weymouth route, but advance notice must be given to enable this to be implemented.

The cost of carriage per pet with a foot passenger between the UK and Channel Islands is £10 each way. Pet owners must provide their own RSPCA approved carriage box suitable for their pet(s). There is no cost for the carriage of pets transported within a vehicle between the UK and the Channel Islands. Pets travelling between the UK and St. Malo and Channel Islands and St. Malo may only be transported in the car at a charge of £15 for the 1st pet each way, and £7.50 per subsequent pet each way. We regret that we are unable to offer the carriage of pets on our conventional ferry service between Portsmouth and Cherbourg. Livestock will only be carried, subject to restrictions imposed by national and local authorities, with prior specific approval from Condor Ferries. Separate charges apply to livestock and application should be made to Condor Ferries for details.

SERVICE VARIATION
Condor does not accept liability in the event of the vessel being diverted to a port, other than the chosen port of destination.
